Mr. Gould is a graduate of Harvard College, magna cum laude, and Columbia University School of Law. He is a member of the Boston Bar Association where he is a past co-chair of the Affordable Housing Committee and of the Legislation and Public Policy Committee, and also is a member of the Real Estate Bar Association for Massachusetts and the Abstract Club, an organization of the top 100 real estate attorneys in Massachusetts. He is rated “AV”, the highest rating, by Martindale-Hubbell, the leading national ranking agency for attorneys.
Kenneth Gould, a partner of the firm, has been practicing in the area of real estate and commercial finance transactions since 1980. His experience includes all aspects and types of commercial real estate and financing transactions, including affordable housing development and finance.

Attorney Gould's practice includes Commercial Real Estate Transactions, Financing Transactions, and Public Sector, Affordable Housing and Non-Profit Transactions. His experience in each of these practice areas is described separately below, so that you may skip ahead to the area of interest to you.
Commercial Real Estate Transactions:
Attorney Gould represents buyers, sellers, lenders, landlords and tenants in connection with the acquisition, sale or other disposition, financing, construction, leasing and development of office, industrial, retail and multi-family properties. In the multi-family area, he is experienced in both rental and condominium projects, and he is recognized as one of the State's leading experts in cooperative housing law. Mr. Gould is familiar with the resolution of title, zoning and environmental permitting issues, as well as with ground and air rights leases, sale-leasebacks, office and retail leases, title opinions, Land Court registration proceedings, historic preservation law, real estate tax abatements, and tax-free exchanges. He is experienced in affordable housing development and finance, as well as urban renewal and economic development projects. Attorney Gould also works closely with the firm's Environmental Law Department in connection with the remediation, redevelopment, purchase, sale, leasing and financing of "brownfields" properties. Attorney Gould serves as agent for several national title insurance companies.
Attorney Gould represents both borrowers and lenders in a wide variety of real estate and commercial loan transactions, including construction, permanent and "mini-perm" loans, non-profit loans, conduit loans, SBA financings, all-asset financings, receivables financings, affordable housing/economic development financings, and work-outs and loan restructurings. He has extensive experience drafting and negotiating notes, loan agreements, mortgages, security agreements, subordination and intercreditor agreements, guaranties, landlord waivers, and all other documents evidencing and securing financing arrangements, as well as reviewing and negotiating opinions, authority documents, title insurance, hazardous materials site assessment (21E) reports, leases, and other due diligence documents. Mr. Gould has served as a special consultant to a major insurance company in connection with the work-out, restructuring (including in bankruptcy proceedings) and securitization of its real estate investments.
Public Sector, Affordable Housing and Non-Profit Transactions:
Attorney Gould has extensive experience representing public and quasi-public agencies, including representation of The Commonwealth of Massachusetts Department of Housing and Community Development since 1994 in connection with financing transactions under the HOME Investment Partnerships Program, Housing Stabilization Fund, Housing Innovations Fund, Facilities Consolidation Fund, Affordable Housing Trust Fund and other programs. He has acted as real estate counsel to both for-profit and non-profit borrowers in connection with financings by the Massachusetts Housing Finance Agency, MassDevelopment (and its predecessor agencies, the Massachusetts Government Land Bank and the Massachusetts Industrial Finance Agency), the Massachusetts Health and Educational Facilities Authority, and various other public and quasi-public lenders. Mr. Gould also represents banks in connection with Community Reinvestment Act and non-profit lending.
In the Affordable Housing area, Attorney Gould is experienced in both rental and homeownership projects, including scattered site projects, limited equity housing cooperatives, and Low Income Housing Tax Credit syndications. He regularly works with DHCD, CEDAC, MHP, MassHousing, HUD and other public and quasi-public agencies, as well as various municipalities.
Attorney Gould has broad experience in municipal real estate law, including representation of counties and municipalities in connection with the acquisition and disposition of real property, road layouts, eminent domain and tax takings and public bidding requirements.
Attorney Gould also frequently represents universities, unions and other non-profit entities in connection with leases, the purchase and sale of real property, ground leases, and other real estate transactions. He has worked with several unions to divide ownership of a property between the union and its pension fund through the structure of a condominium.
